     The Senate met at 11 a.m.

     Prayer was offered by the Honorable Shirley Love, a senator from the eleventh district.
     Pending the reading of the Journal of Monday, February 17, 2003,
     On motion of Senator Smith, the Journal was approved and the further reading thereof dispensed with.
     The Senate proceeded to the second order of business and the introduction of guests.
     The Senate then proceeded to the third order of business.
     A message from The Clerk of the House of Delegates announced the adoption by that body and requested the concurrence of the Senate in the adoption of
     House Concurrent Resolution No. 43--Expressing the best wishes along with a desire for a speedy recovery to the Honorable Cecil Underwood, the past Governor of this State.
     Whereas, The Honorable Cecil Underwood, who twice served with distinction and honor as Governor of this State, was recently hospitalized after receiving heart surgery; and
     Whereas, The Honorable Cecil Underwood, who has the unique distinction of being the youngest man as well as most senior person to serve as Governor of this State, has served this State's interests well, not only as Governor, but also as a civic-minded individual, public official and statesman for many years; and
     Whereas, The Legislature, in appreciation for ex-Governor Underwood's continued and invaluable service to this State and his wise and able stewardship as Governor, wishes to express the sincere and genuine expression of best wishes and speedy recovery during his current recovery and convalescence; therefore, be it
     Resolved by the Legislature of West Virginia:
     
That best wishes and a desire for a speedy recovery are hereby expressed by the members to the Honorable Cecil Underwood, a civic-minded man, honorable public official, gentleman and statesman; and, be it
     Further Resolved, That the Clerk of the House is hereby directed to forward a copy of this resolution to the Honorable Cecil Underwood.
     At the request of Senator Chafin, and by unanimous consent, the message was taken up for immediate consideration and reference of the resolution to a committee dispensed with.
     The question being on the adoption of the resolution, the same was put and prevailed.

     A message from The Clerk of the House of Delegates announced the adoption by that body and requested the concurrence of the Senate in the adoption of
     House Concurrent Resolution No. 44--Extending the Committee of Conference relating to consideration of Com. Sub. for H. B. No. 2122, relating to medical professional liability generally.
     Resolved by the Legislature of West Virginia:
     That pursuant to Rule No. 3 of the Joint Rules of the Senate and House of Delegates, the Committee of Conference is hereby extended for a period of three days for the express purpose of consideration of matters of disagreement between the two houses as to Com. Sub. for H. B. No. 2122.
     At the request of Senator Chafin, and by unanimous consent, the message was taken up for immediate consideration and reference of the resolution to a committee dispensed with.

     Senate Bill No. 187, Authorizing special motor vehicle plates for volunteers and employees of American Red Cross.

     Senate Bill No. 374, Authorizing special license plates for certain female veterans; substitutes "firefighter" for certain words.
     And has amended same.
     Senate Bill No. 539, Authorizing special license plate for members of Harley Owners Group.
     And has amended same.

     And has amended same.

     Senate Concurrent Resolution No. 33--
Requesting the United States government, including President George W. Bush, Homeland Security Secretary Tom Ridge and members of West Virginia's congressional delegation, expedite funding to improve the security of farm produce grown in West Virginia and other states.
     Whereas, There is a real threat that enemies of this country will attempt to commit acts of terrorism which will injure or kill many citizens; and
     Whereas, Enemy agents and terrorist sleeper cells may already have the means to poison or contaminate food sources, including farm produce, in this country; and
     Whereas, No state or local authority has the resources or manpower to provide the necessary security and surveillance that is required to protect these food sources, including farm produce, from sabotage or contamination by acts of terrorism without the help and support of the federal government; and
     Whereas, An improvement in the state's ability to provide surveillance would enhance the ability of the West Virginia Department of Agriculture in providing the leadership and coordination necessary to ensure a safe supply of farm produce in this state; therefore, be it
     Resolved by the Legislature of West Virginia:
     That the Legislature hereby requests the United States Government, including President George W. Bush, Homeland Security Secretary Tom Ridge and West Virginia's congressional delegation, expedite funding to improve the security of farm produce grown in West Virginia and other states; and, be it
     Further Resolved, That the Clerk of the Senate is hereby requested to forward a copy of this resolution to President George W. Bush, Homeland Security Secretary Tom Ridge and the members of West Virginia's congressional delegation.

     Com. Sub. for Senate Bill No. 213, Restricting actions brought by nonresidents in state courts.

     On motion of Senator Jenkins, the following amendment to the bill was reported by the Clerk and adopted:
     On page five, section one, line sixty-eight, after the word "jurisdiction" by changing the period to a colon and adding the following proviso: Provided, That unless barred by the statute of limitations or otherwise time barred in the state where the action arose, a nonresident of this state may file an action in state court if the nonresident cannot obtain jurisdiction in either federal or state court against the defendant in the state where the acts or omissions giving rise to the claim occurred a nonresident bringing such an action in this state shall be required to establish, by filing an affidavit with the complaint for consideration by the court, that such action cannot be maintained in the state where all or substantially all of the acts or omissions giving rise to the claim arose due to lack of any legal basis to obtain personal jurisdiction over the defendant.

Allowing certain vehicle auxiliary lighting devices when vehicle used off road.

     Com. Sub. for Senate Bill No. 399, Providing for criminal history checks for certain people working with children on school property.

     On motion of Senator Deem, the following amendments to the bill were reported by the Clerk, considered simultaneously, and adopted:
     On page three, section ten, lines twenty-three and twenty- four, by striking out the words "parent or guardian volunteers or individuals" and inserting in lieu thereof the words "parents, guardians or volunteers";
     And,
     On page three, section ten, line twenty-seven, after the word "property" by changing the period to a colon and inserting the following proviso: Provided, however, That no criminal background check will be required of any volunteer who is tutoring a student or students under the direct supervision of a classroom teacher.
     The bill (Com. Sub. for S. B. No. 399), as amended, was then ordered to engrossment and third reading.

     On page five, section one, line fifty-three, by striking out the words "two judges" and inserting in lieu thereof the words "one judge".
